Terms of Use

By using any My Arts and Crafts services You agree to be bound by these terms and conditions, acceptable use guidelines, and code of conduct for the My Arts and Crafts website, referred to collectively as the "rules." If you do not agree to be bound by the rules, you may discontinue using My Arts and Crafts  website as your  sole and exclusive remedy.

By posting any content on or through the My Arts and Crafts, you hereby grant to My Arts and Crafts a limited license to use, modify, publicly perform, publicly display, reproduce, and distribute such content on My Arts and Crafts and use said content for advertising purposes. This license is non-exclusive, fully-paid and royalty-free (meaning that My Arts and Crafts is not required to pay you for the use of the content that you post), sublicensable, and worldwide. This license will terminate at the time you remove your content from the My Arts and Crafts website.

You represent and warrant that you own the content posted by you on or through the My Arts and Crafts website or otherwise have the right to grant the license set forth in this section, and the posting of your content on or through the My arts and Crafts website does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person. You agree to pay for all royalties, fees, and any other monies owing any person by reason of any content posted by you to the My Arts and Crafts website.

My Arts and Crafts may delete any content that in it’s sole judgment violates this agreement or which may be offensive, illegal or violate the rights, harm, or threaten the safety of any person. My Arts and Crafts assumes no responsibility for monitoring the My Arts and Crafts website for inappropriate Content or conduct. If at any time My Arts and Crafts chooses, in its sole discretion, to monitor the My Arts and Crafts website, My Arts and Crafts nonetheless assumes no responsibility for the content, no obligation to modify or remove any inappropriate content, and no responsibility for the conduct of the User submitting any such Content.

You are solely responsible for the content that you post on or through the My Arts and Crafts website, and any material or information that you transmit to other members and for your interactions with other users. My Arts and Crafts does not endorse and has no control over the Content.

My Arts and Crafts is not responsible for any incorrect or inaccurate content posted on the My Arts and Crafts website, whether caused by users of the My Arts and Crafts website or by any employee or agent of My Arts and Crafts. Profiles created and posted by members on My Arts and Crafts may contain links to other websites. My Arts and Crafts is not responsible for the content, accuracy or opinions expressed on such websites, and such websites are in no way investigated, monitored or checked for accuracy or completeness by My Arts and Crafts.

The My Arts and Crafts website is provided "AS-IS" and as available and My Arts and Crafts expressly disclaims any warranty of fitness for a particular purpose or non-infringement. My Arts and Crafts cannot guarantee and does not promise any specific results from use of the My Arts and Crafts website.

My Arts and Crafts makes no warranties of any kind, either expressed or implied, for the service it is providing. My Arts and Crafts will not be held responsible for any damages you suffer or inflict upon another party. This includes loss resulting from service interruptions, delays, non-deliveries or mis-deliveries caused by My Arts and Crafts negligence or your own actions and/or errors.

My Arts and Crafts operates it services subject to and in accordance with all applicable local, state, and federal laws. You agree to indemnify and hold harmless My Arts and Crafts, and all agents, subcontractors and affiliates from any civil claims or criminal charges resulting from your use of the service that causes direct or indirect damage to another party or violates any law. You also agree to indemnify and hold My Arts and Crafts harmless from any and all lawsuits, judgments, decrees, costs and expenses, and attorney fees arising from the your use of the My Arts and Crafts website. You agree to defend, indemnify and hold blameless My Arts and Crafts and its sponsors, partners or other co-branders and/or affiliates harmless from and against any and all claims, losses, damages, liabilities and costs (including, without limitation, reasonable attorneys' fees and court costs) (collectively, "claims") arising out of or relating to the your breach of any of these Rules or use (by you or any third party) of My Arts and Crafts through the My Arts and Crafts account assigned to you, including negligence by My Arts and Crafts. The foregoing indemnification obligation shall survive any termination of My Arts and Crafts provided to you.

IN NO EVENT SHALL MY ARTS AND CRAFTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF MY ART AND CRAFTS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, MY ARTS AND CRAFS’S LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO MY ARTS AND CRAFTS FOR THE SERVICES DURING THE TERM OF MEMBERSHIP.

 
My Arts and Crafts failure to insist upon or enforce strict performance of any Rules shall not be construed as a waiver of any term or condition or right.

In all cases My Arts and Crafts has the final say on what does and does not constitute an "Acceptable Use".

These Terms of use may be altered at any time without notice.

Code Of Conduct

All My Arts and Crafts site members and guests are responsible for knowing the information contained in the following Code of Conduct.

The My Arts and Crafts Administration reserves the right, but does not assume the responsibility, to restrict communication which Admins deem in its discretion to be harmful to individual guests, damaging to the community as a whole, or in violation of My Arts and Crafts’ or any third-party rights.

Prohibited profile content, private messaging, board posting, and e-mailing, behaviors include (but are not limited to):

·         profanity, vulgarity, or explicit content For example:

• "masking" by using alternative characters/spellings and spaces to get around profanity filters, leet-speak, and combinations of words that produce an offensive result.
• "filter testing"
• discussion of sexually explicit material
• discussion of graphic violence

·         hate speech (e.g. racial, ethnic, sexist, homophobic and religious slurs)

·         promotion of or engaging in certain illegal activities, For example: drugs, drug paraphernalia, rape or solicitation of a minor, computer hacking, and copyright violation

·         harassment of another specific person (e.g. persistent flaming or continued personal attacks on the boards.)

·         trolling or baiting by putting to the screen inflammatory statements designed to elicit a negative response from the community

·         spamming through repeated posts, or off-topic content by word or intent to boards or lists (e.g. scrolling, flooding, polling, or by "bumping" a boards post more than once in 48 hours)

·         No useless posts. This includes: Thread bumping, useless one liners, Flamewars, Trolling and Spamming. What is spamming? Read this. 

·         impersonation of another person, site staff or another member by either screen name or self-representation (e.g. faking a screen name by using similar-looking characters, "spoofing" speech in a chat room, or claiming to hold an official title or position relating.)

·         reregistering a banned username, a variation of a banned name, or declarations under a new screen name that you are "really" the banned name or attempts to resubscribe under another address after being put on REVIEW by the moderator.

·         off-topic posts or thread hijacking.

These disruptive behaviors are grounds for removal; My Arts and Crafts site admins are the final judges of whether a member's behavior qualifies as inappropriate or a disruption.

·         only one account per user

• Check that your question has not been answered anywhere else on the site. Use the search feature (both on site content and forum).
• Post your comment/question to the most appropriate place. Any posts deemed to be in the wrong forum will be moved. Do not cross-post the same question to multiple places.
• Thank those who help you. Acknowledgement of a helpful suggestion not only placates those who helped you, it may also help others with a similar problem. All those who have been helped on this forum are invited to help other users by responding to their questions when they know the answer and /or to consider donating to the project.

In other words, behave yourself. Treat other people you encounter in the rooms just as you would treat them in person--politely.

Disciplinary Procedures

If a member of My Arts and Crafts has demonstrated he or she cannot behave, the member will initially have his/her profile banned and will eventually LOSE his or her username.

These procedures are only meant to be rough guidelines, as each profile, board, and content situation is different and may require other measures to ensure the community orientation of the site.

You Can Make My Arts and Crafts a Better Place

Our moderators can't be everywhere at once. Therefore, if you witness actions in boards, or other areas that you believe harms a guest, damages the community, or violates My Arts and Crafts or some third-party's rights, please make a note of the time/place where the event occurred and contact a moderator or site admin immediately.
